Daila HubTerms of Service

These terms govern your use of dailahub.com, our apps and our messages (the "Service"), operated by Edwenson Raphael ("Daila Hub", "we", "us"). By using the Service you agree to these terms and to our Privacy Policy.
Accounts
- You must be at least 13 years old to create an account, and old enough to form a binding contract where you live, or have a parent's or guardian's permission.
- Give accurate information and keep your sign-in details secure. You are responsible for activity on your account.
- You may delete your account at any time in your account settings.
Hosting events
- You are responsible for the events you create, the content you publish and the people you invite.
- Invite only people you have a reason to contact about your event, and use guest information only for that event.
- You keep ownership of the content you upload. You give us a license to host, display and send it as needed to run the Service for you and your guests.
Acceptable use
Do not use the Service to send spam or unsolicited messages, to harass anyone, to publish unlawful, infringing or harmful content, to collect other people's information without permission, to interfere with or probe the Service's security, or to access it by automated means beyond normal use. We may remove content or suspend accounts that break these rules.
Paid plans
- Some features require a paid subscription. Prices and plan features are shown before you subscribe.
- Subscriptions renew automatically each billing period until you cancel. You can cancel in your billing settings; your plan stays active until the end of the period you have paid for.
- Payments are processed by Stripe under Stripe's terms. Except where the law requires, payments are non-refundable.
SMS verification program
- Program: Daila Hub verification codes.
- What you receive: one-time codes for signing in to Daila Hub, sent only when you request one. No marketing messages are sent.
- How you opt in: by entering your mobile number on the phone sign-in screen and agreeing to receive verification codes.
- Frequency: varies with your account activity, typically one message per sign-in.
- Cost: message and data rates may apply.
- Opt out: reply STOP at any time. You will get one confirmation message and no further texts. This turns off text-message sign-in; if your account also has an email and password, you can still sign in with those. Reply START to opt back in.
- Help: reply HELP, or email support@dailahub.com.
- Carriers are not liable for delayed or undelivered messages.
- Your mobile number is handled as described in our Privacy Policy and is never shared for marketing.
Third-party services
The Service relies on third parties, including maps and address search. Address search is provided by Amazon Location Service; see the Amazon Location Service terms of use and data attribution. Map data © OpenStreetMap contributors, tiles by OpenFreeMap. Your use of a third-party service may also be subject to its own terms.
Changes and availability
We may change, suspend or stop any part of the Service. We may update these terms; if a change is material, we will update the effective date and notify account holders. Continuing to use the Service after a change means you accept it.
Termination
You may stop using the Service at any time. We may suspend or end your access if you break these terms or if we must to protect the Service, our users or others.
Disclaimers
The Service is provided "as is" and "as available", without warranties of any kind, express or implied, including fitness for a particular purpose and non-infringement. We do not guarantee that messages, invitations or codes will be delivered on time or at all.
Limitation of liability
To the fullest extent the law allows, Daila Hub is not liable for indirect, incidental, special, consequential or punitive damages, or for lost profits, data or goodwill. Our total liability for any claim relating to the Service is limited to the greater of the amount you paid us in the 12 months before the claim or US $50.
Indemnity
You agree to defend and indemnify Daila Hub against claims arising from your content, your events or your breach of these terms.
Governing law
These terms are governed by the laws of the State of Delaware, without regard to its conflict-of-laws rules. Disputes will be resolved in the state or federal courts located in Delaware, unless the law where you live requires otherwise.
